At mejo, LLC (with our affiliates, subsidiaries and related entities, collectively, “Mejo” “we,” “us” or “our”), in order to provide our products and services to you, we must collect, use and share personal information about you. This privacy policy (“Privacy Policy”) describes the types of information we may collect from you or that you may provide when you visit the website mymejo.com, or our mobile applications (inclusively, the “Mejo Site”), or use our products and services (inclusively, our “Services”), how and why that information is collected, how we protect, maintain and use it, and when and with whom we share or disclose it. This Privacy Policy also outlines what choices you can make about how we collect, use and share your information, including your Personal Information.

This Privacy Policy applies to information we collect about you in any physical locations, through our call center, when you otherwise communicate with us, when you use the Mejo Site, and when you use our Services. This Privacy Policy does not apply to any third parties or any websites that might be reached from a link on the Mejo Site or our Services (“Linked Sites”). We are not responsible for the privacy practices, policies, or content of any Linked Sites, and do not control how Linked Sites collect or use your information, including Personal Information. We encourage you to read and understand the privacy policies of any Linked Sites that you visit.

Our Services are for United States Users

Mejo’s website is hosted in the United States and our Services are intended only for and is only available to residents of the United States. If you are a resident of another country, by providing your information, including any Personal Information, you are permitting the transfer of your information, including any Personal Information, to the United States, which may not provide the same protections to your Personal Information as the data protection laws of the country in which you reside. The use of your Personal Information will be in accordance with this Privacy Policy and not that of your resident country.

Children's Privacy Policy

The Mejo Site and our Services are not intended to be used by persons under 18 years of age. If you are under 18 years of age, you are prohibited from Uploading any User Content, as those terms are defined in our Terms of Use. Do not use or provide any information to the Mejo Site or our Services or through any of its features, or provide any information about yourself to us, including but not limited to your name, address, telephone number, email address, any screen name or username you may use.

In accordance with our Terms of Use, if you are a parent or guardian of an unemancipated minor you may use the Mejo Site and our Services to Upload User Content regarding or concerning such minor, including Personal Information and Personal Health Information on behalf of such minor in compliance with those legal rights, our Terms of Use, and this Privacy Policy. By doing so, you represent and warrant that you have the legal authority and power to do so and you acknowledge and agree, in such capacity, that all provisions of this Privacy Policy that are applicable to you are equally applicable to such minor.

Any information that you provide us while using the Services on behalf of such minor child will be treated as Personal Information or Personal Health Information as defined herein. We do not knowingly collect Personal Information or Personal Health Information from persons under the age of 18, including children under 13.

 

If we learn we have collected or received Personal Information from a child under 13 without parental consent, we will delete that information. If you believe we might have any information from or about a child under 13 without parental consent, please contact us at contact@mymejo.com. What Information We Collect

Mejo collects certain personal information when you establish an account including your name, email address, telephone number (“Personal Information”). If you fill out free form fields present in the Services with your or another person’s personal information, we collect that Personal Information. If you fill out free form fields present in the Services with your or another person’s personal health information (“Personal Health Information”), we also collect that Personal Health Information.

How We Collect Information

We collect information including but not limited to Personal Information and Personal Health Information that you provide directly to us when you register for access to the Mejo Site, and when you use the Mejo Site and our Services, including from User Content that you Upload, as those terms are discussed and defined in our Terms of Use incorporated herein. We do not collect information including Personal Information or Personal Health Information about you from third parties or from technology tracking tools, except as described below. We do not collect Personal Information or Personal Health Information automatically other than as you input it into the Services. We may tie information about you that you provide to us or that we collect from other sources to Personal Information. We do not use automated decision making to profile our users.

Information We Collect Through Automatic Data Collection Technologies. As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to the Mejo Site and use of our Services, including traffic data, location data, chat logs, and other communication data and the resources that you access and use on the Mejo Site or through our Services.

  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

  • Information generated while you are using the Mejo Site and our Services, including when, how often and under what circumstances you use the Mejo Site and our Services.

 

We also may use these technologies to collect information about your activities on the Mejo Site over time.

 

We may maintain or associate the information we collect automatically with Personal Information we collect in other ways or receive from or share to third parties, including sharing information with for analyzation by Google Analytics, a third party, whose use of cookies/ClientIDs help us understand the use and users of the Mejo Site, to help us improve the Mejo Site and our Services and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize the Mejo Site and our Services according to your individual interests.

  • Speed up your searches.

  • Recognize you when you return to the Mejo Site or use our Services.

 

The technologies we use for this automatic data collection may include:

  • Details of your visits to the Mejo Site and use of our Services, including traffic data, location data, chat logs, and other communication data and the resources that you access and use on the Mejo Site or through our Services.

  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

  • Information generated while you are using the Mejo Site and our Services, including when, how often and under what circumstances you use the Mejo Site and our Services.

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website. Cookies also include persistent ClientIDs used by Google Analytics, a third party.

  • Web Beacons. Pages of our Website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

 

How We Use Your Information, including Personal Information and Personal Health Information

Mejo uses information that we collect about you or that you provide to us, including your Personal Information and Personal Health Information to provide the Services or to help personalize our Services and to market to you. We also use Personal Information to support our business functions, such as fraud prevention and complying with legal obligations. Some examples include:

  • Details of your visits to the Mejo Site and use of our Services, including traffic data, location data, chat logs, and other communication data and the resources that you access and use on the Mejo Site or through our Services.

  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

  • Information generated while you are using the Mejo Site and our Services, including when, how often and under what circumstances you use the Mejo Site and our Services.

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to ask a question about our products or Services, we will use that personal information to respond to your inquiry. If you provide your Personal Information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process returns.

  • To provide, support, personalize, and develop the Mejo Site and our Services.

  • To create, maintain, customize, and secure your account with us.

  • To process your requests, purchases, transactions, and payments and prevent transactional fraud.

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.

  • To personalize your experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through the Mejo Site and our Services, third-party sites, and via email or text message (with your consent, where required by law).

  • To help maintain the safety, security, and integrity of the Mejo Site and our Services, databases and other technology assets, and business.

  • For testing, research, analysis, and product development, including to develop and improve the Mejo Site and our Services.

  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations

  • As described to you when collecting Personal Information and/or Personal Health Information.

  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information and/or Personal Health Information held by us about our users is among the assets transferred.

  • To notify you about changes to the Mejo Site or our Services.

  • For any other purpose with your consent.

 

Surveys, Feedback, Informational Programs. From time to time you may receive survey requests through emails or displays within the Mejo Site or our Services that request feedback on a variety of topics. If you choose to engage with or use one of these requests, you may be asked to provide information that may be used to supplement information that you submitted to the Mejo Site or through our Services, and which may be used for the above purposes including marketing purposes.

 

How We Share Your Personal Information and Personal Health Information

Mejo shares and discloses your Personal Information under the following circumstances:

  • Service Providers: We may share your Personal Information with service providers that help with our business activities, including development, maintenance, and support of the Mejo Site and our Services, marketing research and analysis, communications, and customer service. We require our business partners and service providers to keep your Personal Information secure

  • Legal Requirements and Protection: We may share your Personal Information in special circumstances or when we believe sharing will help to protect the safety, security, property or rights of Mejo, our third party business partners and service providers, our customers, our employees or other persons, including:
    o To comply with law, a court order, or other legal process, or in connection with a legal investigation or a request for cooperation by a government entity.
    o To protect against fraud or for other risk management purposes.
    o To enforce our Terms of Use and any other applicable terms, conditions and other agreements.
    o As permitted by our Terms of Use.

  • Business Transfers: We may share your Personal Information in connection with a corporate transaction (such as a merger, financing, acquisition or dissolution) or proceeding involving the sale, transfer, divestiture, or disclosure of all or a portion of Mejo’s business or assets. In the event of an insolvency, bankruptcy, or receivership, information, including Personal Information may also be transferred as a business asset of Mejo, provided that the acquirer will assume the rights and obligations with respect to your Personal Information as described in this Privacy Policy.

  • With Your Consent: In circumstances other than those described above, we will ask for your affirmative consent before we share your Personal Information to a third party. You may withdraw that consent at any time by sending us an email to contact@mymejo.com.

  • At Your Choice or By Your Direction:

    • You may choose to electronically share Personal Information or Personal Health Information with others, which may include but not be limited to caregivers or support personnel. By your act of sharing, or if you provide that other your account credentials, the shared party may be able to view all of your information including Personal Information and Personal Health Information, and they may have the same level of access to your information including Personal Information and Personal Health Information that you do.

    • You may choose to share some or all of the Personal Information or Personal Health Information that you have provided to our Services by printing out reports.

    • We remind you that pursuant to our Terms of Use if you share, or authorize that Personal Information or Personal Health Information entered into our Services be shared, any such sharing is at your own risk. We cannot and do not control the safety, security, or privacy of information including Personal Information or Personal Health Information that you share, or authorize to be shared, with others.

  • Anonymized Data: We may anonymize Personal Information and/or Personal Health Information so that it no longer identifies the data subject and may sell it or share it with third parties in a variety of ways including for research or commercial marketing purposes, for example by providing anonymized reports about health conditions, diet, activity, and health patterns.

 

Mejo shares and discloses your Personal Health Information under the following circumstance:

  • Where you have consented to that disclosure. We will ask for your affirmative consent before we share your Personal Health Information to a third party. That affirmative consent is separate from your acceptance of our Privacy Policy and Terms of Use at account creation. You may withdraw your affirmative consent at any time by sending us an email to contact@mymejo.com.

Third-Party Use of Tracking Technologies

Some content or applications, including advertisements, on the Mejo Site or through our Services, are served by third parties, which may include advertisers, ad networks and servers, and application providers. These third parties may use tracking technologies to collect information about you when you use the Mejo Site or our Services. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

 

Authorization and Consent to Sharing by Text/SMS Messaging

If you decide to share some or all of the Personal Information or Personal Health Information associated with your Mejo Site account with a third party by text/sms messaging, you hereby confirm that by requesting that Mejo, as transmission intermediary, share that Personal Information or Personal Health Information with that third party by text/sms messaging, you have previously obtained consent from that third party for Mejo to contact and share that information with that third party by text/sms messaging on your behalf.

 

How Your Data Is Protected

We seek to keep your Personal Information and Personal Health Information secure and implement reasonable safeguards to help us protect such information from unauthorized access, use, and disclosure. We maintain reasonable administrative, technical, and physical safeguards designed to protect the information collected via the Mejo Site and the Services and encrypt all data in motion and at rest. All information you provide to us is stored on our secure servers behind firewalls. Your User Content Uploads are stored in a database that restricts outside connectivity other than through the Mejo Site. Our access to that data is limited by job role to a limited set of administrators for the purposes set out in this Privacy Policy and their access requires credentials including a time-based one-time password authentication to log in. These measures are designed to reasonably secure your Personal Information and Personal Health Information from accidental loss and from unauthorized access, use, alteration, and disclosure.  We cannot and do not guarantee that your Personal Information or Personal Health Information will never be accessed, used, or disclosed in a manner that is inconsistent with this Privacy Policy. See our Terms of Use for important disclosures, disclaimers, and limitations of liability.

 

The transmission of information via the internet, including to and from the Mejo Site and our Services, is not completely secure. Any transmission of Personal Information or Personal Health Information is at your own risk. In providing your information, including Personal Information and Personal Health Information, you acknowledge that transmissions by you to or from our Services, including Uploads of User Content, are non-confidential and that others may read and/or intercept such transmissions including Personal Information and Personal Health Information.

 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Mejo Site or to use our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

 

YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY AND SECURITY OF YOUR LOGIN INFORMATION, PERSONAL INFORMATION, ANY USER CONTENT, AND FOR ALL YOUR ACTIVITIES, TRANSMISSIONS AND CONSEQUENCES THEREOF IN RELATION TO THIS SITE, INCLUDING AS A RESULT OF YOUR SHARING INFORMATION OR PERSONAL INFORMATION OR PERSONAL HEALTH INFORMATION INSIDE OR OUTSIDE OF OUR SERVICES. MEJO IS NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE TO YOUR INFORMATION INCLUDING PERSONAL INFORMATION OR PERSONAL HEALTH INFORMATION THAT RESULTS FROM YOUR USE OF OUR SERVICES, OR LOSS OR DAMAGE THAT ARISES FROM USE OR MISUSE OF YOUR INFORMATION INCLUDING PERSONAL INFORMATION OR PERSONAL HEALTH INFORMATION RESULTING FROM YOUR USE OF OUR SERVICES.

 

In providing your information, you acknowledge that transmissions by you to or from our Online Services are non-confidential and that others may read and/or intercept such transmissions including Personal Information. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITYAND SECURITY OF YOUR LOGIN INFORMATION, PERSONAL INFORMATION, ANY WORKPRODUCT, AND FOR ALL YOUR ACTIVITIES, TRANSMISSIONS AND CONSEQUENCESTHEREOF IN RELATION TO THIS SITE, INCLUDING AS A RESULT OF YOUR SHARINGINFORMATION OR PERSONAL INFORMATION INSIDE OR OUTSIDE OF OUR ONLINESERVICES. We process all credit card payments through third party payment processors. We do not collect, store or retain credit card information or related data used to authenticate you.

 

“Phishing” is a scam designed to steal your information. If you receive an email that looks like it is from us asking you for your Personal Information or Personal Health Information, please do not respond to that email or provide any Personal Information or Personal Health Information to the sender. Instead, please notify our Customer Experience team at contact@mymejo.com.

 

What Are Your Choices

Marketing Preferences. Mejo does not trade, rent, sell, loan, lease, use for secondary or unrelated purposes or share with any third party any Personal Information or Personal Health Information it collects without your consent. We requested your consent to our Terms of Use and Privacy Policy when you signed up for the Services. BY CLICKING THE CHECKBOX REFLECTING YOUR AGREEMENT TO OUR TERMS OF USE AND PRIVACY POLICY, YOU HAVE CONSENTED TO (A) MEJO’S COLLECTION AND USE OF PERSONAL INFORMATION AND PERSONAL HEALTH INFORMATION FOR MEJO’S OWN MARKETING PURPOSES, AND (B) MEJO’S SHARING OF YOUR PERSONAL INFORMATION (BUT NOT PERSONAL HEALTH INFORMATION) WITH THIRD PARTIES FOR MARKETING PURPOSES. You may withdraw that consent at any time by sending us an email to contact@mymejo.com.

We use an opt-out standard for email. Opt-out means we may email you but will stop upon your request (as described herein). If you contact us by email or mail, please be sure to include your full name, the types of communications you would like to receive or not receive, and your related contact information. For instance, if you would like to opt out of email, include your email address. Please allow sufficient time for your marketing preferences to be processed. It may take up to ten (10) days to process your requests related to email and up to thirty (30) days to process your requests related to sharing information with your consent. Since we do not accept opt-out requests from third parties, such as catalog opt-out services, please communicate your request directly to us through one of the mechanisms mentioned above. Please know that even if you opted out of receiving marketing communications from us, we may still contact you for transactional or informational purposes as set forth in this Privacy Policy and our Terms of Use.

 

How To Access And Update Your Personal Information.  We provide you with the opportunity to update and/or delete certain Personal Information and to opt out of having your Personal Information or Personal Health Information used or disclosed for certain purposes. For example, you may:

  • Correct or update your Personal Information;

  • Request that we do not share your Personal Information or Personal Health Information with third parties for their marketing purposes.

  • Request access to your Personal Information.

We may revise and update this Privacy Policy from time to time in our sole discretion. All changes are effective immediately when we post them to the Mejo Site, and apply to all access and use of the Mejo Site and our Services thereafter. Please check our Privacy Policy periodically to see if it has been updated. If a change to this Privacy Policy materially affects the use or disclosure of your Personal Information, we will notify you by placing a more prominent notice on our home page. By continuing to use the Mejo Site or our Services, providing us information, or otherwise interacting with us thereafter, you agree to accept such changes to this Privacy Policy. Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information's nature and processing purpose.

Information For Nevada Residents

If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties. You can exercise this right by emailing us at contact@mymejo.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account.

 

California "Shine The Light" Law

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of the Mejo Site and our Services that are California residents to request once per calendar year certain information regarding our disclosure of personal information (as defined in the statute) to third parties for their direct marketing purposes. If you are a California resident, to make such a request please email us at contact@mymejo.com. Please specify that you are submitting a “California Privacy Rights Request.”

 

Privacy Rights For California Residents

If you are a California resident, you can make certain requests regarding your personal information. We will fulfill each of these requests to the extent required by law.

You Can Ask Us What Personal Information We Have About You. If you make this request, we will return to you (to the extent required by law):

  • The categories of personal information we have collected about you.

  • The categories of sources from which we collect your personal information.

  • The business or commercial purpose for collecting or selling your personal information.

  • The categories of third parties with whom we share personal information.

  • The specific pieces of personal information we have collected about you.

  • A list of categories of personal information that we have sold, along with the category of any other company we sold it to. Any of the categories of personal information that we collect could be included in a sale to other companies. If we have not sold your personal information, we will inform you of that fact.

  • A list of categories of personal information that we have disclosed for a business purpose, along with the category of any other company we shared it with.

  • You can ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to personal information we collected about you in the previous 12 months.

 

You Can Ask Us To Delete Your Personal Information. You have the right to ask that we delete your personal information. Once we receive a request, we will delete your personal information in our possession (to the extent required by law) as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information, you may not be able to use certain website or in-store functions that require your personal information to operate.

 

You Can Ask That We Stop Selling Your Personal Information. You have the right to direct us not to sell personal information we have collected about you to third parties now or in the future. California law provides that if you are under the age of 16, you have the right to opt in, or to have a parent or guardian opt in on your behalf, to such sales. If you submit a request to stop selling your personal information, we will stop making such transfers.

 

We Will Not Discriminate Against You For Exercising Your Rights. This generally means we will not deny you products or services, charge different prices or rates, provide a different level of service or quality of goods, or suggest that you might receive a different price or level of quality for goods. Please know, if you ask us to delete or stop selling your data, it may impact your experience with us, and you may not be able to participate in our Services which require usage of your Personal Information to function.

Changes to Policy for California Privacy Rights. We may update this California Privacy Rights Policy from time to time effective upon posting the revised Policy, along with the date on which it was most recently updated, on our Services. If a change to this Policy materially affects the use or disclosure of your Personal Information, we will notify you by placing a more prominent notice on our home page.
